In this document, “Thanic”, “the Provider”, “we”, or “Pymwin” refers indistinctly to Thanic Capital SL as identified above.

2. Purpose of the website and service

Through the website pymwin.com and its associated subdomains, Thanic Capital SL makes available to service professionals (including, without limitation, physiotherapists and podiatrists) a software-as-a-service (SaaS) platform for the integral management of their business, including (without limitation): appointment management, calendar, patient/client management, team management, point-of-sale and invoicing, online booking, and other auxiliary modules.

Use of the service is subject to the Terms of Service and the Privacy Policy published on this website. Acceptance of these documents is a prior and necessary requirement to use the platform.

3. Intellectual property

All content on the website (text, images, graphics, logos, icons, software, graphic design, source code, and any other creation susceptible to protection) is owned by Thanic Capital SL or by third parties who have authorized its use, and is protected by national and international intellectual and industrial property laws.

The “Pymwin” trademark, its logo, and the associated distinctive signs are owned by Thanic Capital SL.

The reproduction, distribution, public communication, transformation, or any other form of exploitation, in whole or in part, of the website’s content is expressly prohibited without the express written authorization of Thanic Capital SL, except where the law specifically allows it.

Thanic Capital SL reserves the right to deny or withdraw access to the website and/or the platform, without prior notice, to any user who fails to comply with these conditions.

5. Disclaimer of warranties and liability

Thanic Capital SL does not guarantee the uninterrupted availability and continuity of the website or the platform, although it will apply all reasonable means to ensure such availability. Thanic Capital SL is also not responsible for damages arising from:

• Interruptions, computer viruses, breakdowns, or disconnections in the operational functioning of the electronic system, caused by reasons beyond Thanic Capital SL’s control.
• Delays or blockages in use caused by deficiencies or overloads of the Internet or other electronic systems.
• Acts or omissions of third parties that violate the conditions established in this Legal Notice.
• Improper or incorrect use of the website or the platform by the user.

The above is without prejudice to compliance with the service levels contractually committed in the Terms of Service.

8. Governing law and jurisdiction

In particular, Spanish Law 34/2002 on Information Society Services, Regulation (EU) 2016/679 (GDPR), and Spanish Organic Law 3/2018 on Personal Data Protection and guarantee of digital rights apply.

For the resolution of disputes, the parties submit to the courts and tribunals of Bilbao (Bizkaia), with express waiver of any other jurisdiction that may correspond to them. However, where the user qualifies as a consumer under applicable law, the courts and tribunals of the user’s domicile shall have jurisdiction, and such jurisdiction may not be modified by this Legal Notice.
